The Anglo-Portuguese Society (APS, or the Society) is a registered charity in England (No. 313589), with registered office at 7-8 Great James Street, London, EC1 3DF, and registered with the Information Commissioner's Office (ICO) under registration reference ZA247439.

All content within The Anglo-Portuguese Society website (www.apsociety.co.uk) is intended for personal or private use. Please read and respect the following Terms of Use which sets out how you can access, browse and use our Website.

Please note that the intellectual property rights in all 'Content' (including images, editorial or descriptive text, footage or any other media) featured within this site (www.apsociety.co.uk) and selected social media platforms (Facebook and LinkedIn) is owned by The Anglo-Portuguese Society (the Executive Committee) and other copyright owners as specified wherever possible.

By using our site, you confirm that you accept these terms of use and that you agree to comply with them.

2.     Third Party Content

The APS has made reasonable efforts to identify any Content in which a third party owns copyright ("Third Party Content"), and to secure permission for its use only by the APS.

Therefore, it is your responsibility to secure any permission or consent required for your own use of such Third Party Content.

3.      Links to other websites

This website contains links to other websites that are operated by third parties. The APS does not accept any liability over the content of these third party sites. The existence of these links do not constitute an endorsement of such websites, and your linking to these sites is at your own risk. 

For all uses, a sufficient acknowledgment must be made to the copyright holder of work.

4.        Content Accuracy

Whilst all reasonable efforts have been made to ensure the accuracy of content, no responsibility can be taken for any error or omission. No advice or information, whether oral or written, obtained by you by whatever means shall create any warranty not expressly made in these terms of service or imposed by law.

5.        Photography

All photographs that have been taken at APS events are the exclusive rights of the APS, taken by contracted photographers, Executive Committee members or guest attendees who have granted use of the photographs in question.

6.        Membership Applications

Individual membership data is limited to the Member and designated officers of the Executive Committee only. When you apply for membership you are stating that you are over 18 years of age to use the membership for which you are registering. You agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate and complete, and that you will ensure that this information is kept accurate and up to date at all times.

7.   Payment

Payment can be made by any of the options advertised on our website or invoices.  

Payment online: Our secure server software encrypts all your payment card details. The process scrambles all the information, allowing no unauthorised third party to intercept the data. Your browser will confirm that you are processing your payment in a secure environment by showing either a locked padlock icon or an image of a padlock next to the payment details in the relevant area of the Website.

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases.

By accepting these terms you consent to such checks being made. You can rest assured that this is done only to confirm your identity, that a credit check is not performed. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998 and from 25 May 2018 the General Data Protection Regulation (GDPR).

8.     Password

When you register for membership using www.apsociety.co.uk you will a unique password is generated. You must keep this password confidential and must not disclose it to or share it with anyone. You will be deemed responsible for all activities that occur under your password. If you know or suspect that someone else knows your password, you should notify us immediately. If you forget your password, you must request a new one. No record of your password will be held by the APS.

9.   Sharing and uploading content to the APS website or Social Media

By sharing and uploading Content to our website or by Social Media, you grant the APS free of charge, permission to use that Content in any way it wants (including modifying it and adapting it for operational and editorial reasons).

You grant the APS an irrevocable, non-exclusive, royalty free, perpetual and worldwide licence to use, reproduce and make available to anyone we choose your Content in any medium and to publish such reproductions in publications including but not limited to newsletters, leaflets, exhibition-related materials, event advertising, internal management systems, on the APS Website and on other website to which the APS contributes material where the items are made available on a non-commercial basis and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in our Privacy Policy.

When you submit Content, you are also waiving your right to be identified as the author of the Content and waiving your right to object to derogatory treatment of the Content by the APS.

When you submit Content, you are confirming that your material is your own original work and that you are fully entitled to grant to the APS non-exclusive rights to use it. You should not violate, plagiarise, or infringe the rights of any third parties including copyright, trade mark, trade secrets, privacy, and publicity, personal or proprietary rights.

Please do not submit Content that features people that have not expressly agreed in writing to have their image made available to the APS on these terms and where Content features children under 16 years of age please also secure the written consent of their parent or guardian.

You agree that any Content that you provide is in no way defamatory, illegal or offensive. The APS reserves the right to remove reject Content that it deems unsuitable. This will include Content that is unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, politically motivated, racially offensive, sexist, homophobic, biphobic, transphobic or otherwise objectionable to or inconsistent with the APS or its values.

The APS reserves the right to use none, part or all of the Content that you submit and may delete any contribution published onto its website or Social Media at any time.

If you do not want to grant to the APS the above rights or cannot provide the warranties set out above, please do not upload your Content.

10.   Copyright Statement

The APS is a Charity and aims to provide access to its events for diverse audiences at all times.

The APS makes reasonable efforts to protect its own intellectual property rights and the rights of others. If you believe that the use of Content (including images, editorial or descriptive text, footage or any other media) found on the APS's Website infringes yours or someone else's rights, please contact us, providing the information requested below:

·        Nature of the complaint

·        The full web address of where you found the material

·        Proof that you are the rights holder

This Copyright Statement does not obligate the APS to respond to all complaints or other correspondence received about alleged unauthorised use of third party rights. However, the APS will respond to and take any action it considers necessary in respect of all genuine and evidenced complaints or other correspondence received about all such alleged unauthorised use of third party rights.

11.   Donation Refunds

The APS works hard to ensure the process of making a donation is streamlined and trouble free. However we realise that sometimes mistakes can happen. Under charity law, charities are not permitted to refund donations, other than in specific circumstances specified by the Charities Act 2011. If a mistake has occurred or you would like to discuss your donation please contact info@apsociety.co.uk or give us a call on 0203 371 8767

We are happy to help and we'll ask you a few questions to determine what's happened so that we can help in any way we can. We are committed to the highest standards of legal compliance and we treat all requests for refunds with the utmost importance. Your concerns are important to us and we want to reassure you that we'll update you every step of the way. Before we are able to consider your request, we will need some paperwork from you as can't proceed without it. Once we receive everything, we can then advise you on how long things will take - usually 7-10 working days.

13. Limitation of Liability

The APS does not guarantee that access to this website will be uninterrupted, that this website will be free from viruses or that this website cannot be tampered with by third parties. 

You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

The APS assumes no responsibility for the content of websites linked to or from the Websites. Such links should not be interpreted as endorsement by the APS of those linked websites and the APS will not be liable for any loss or damage that may arise from your use of them.

14.  No waiver

No failure by the APS to exercise or enforce any of its rights under these Terms of Use will be deemed to be a waiver of such rights or a bar to their exercise or enforcement in the future.

15.  Data protection

The APS , we collect and use personal data only as it might be needed for us to manage your membership/providing regular updates to contacts who have opted-in to receiving regular updates/ event registration, except for such purposes, will not provide that information to any third party and will otherwise comply with all applicable laws (including the Data Protection Act 1998 and from 25 May 2018 the General Data Protection Regulation (GDPR).

16.   Law and jurisdiction

These Terms of Use are governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction over any dispute arising from them.

17.   Terms and conditions for buying event tickets

·        Please ensure you select the correct ticket rate prior to final confirmation. AS A RULE, TICKETS CANNOT BE EXCHANGED OR REFUNDED.

·        Exceptionally, the APS will refund a ticket, circumstances will be reviewed on a case by cases basis.

·        The APS reserves the right to amend or make alterations to the published details of the event as shall become necessary.

·        The APS reserves the right to refuse admission and may on occasion conduct security searches to ensure the safety of guests.

·        Ticket are valid for one admission only.

·        The APS shall not be responsible for loss or damage to personal property brought into venues where events are held.

18.   Modification of the Terms and Conditions

The APS may modify the terms of this agreement on this site. You agree to periodically review this agreement to be aware of any such revisions. Should the revision be unacceptable to you, you agree to stop accessing this site. Your continued use of this website following such notification of any such revision(s) shall be deemed as acceptance of and agreement to abide by all such revisions.
